These Customer Terms of Use (“Terms”) govern your use of SOFFSports.com, the SOFF Sports Customer App, WDDT memberships, bookings, Community Pulse, and other customer-facing services operated by Sofficient Systems Inc. (“SOFF Sports,” “we,” “us,” or “our”).
By creating an account, purchasing a service, making a booking, or using the Customer Services, you agree to these Terms.

2. Eligibility and Minors
The Customer Services may be used by adults and, where permitted, minors.
If you are under the age of majority in your province or territory, a parent or legal guardian may need to review or agree to these Terms on your behalf.
For children under 13, SOFF Sports generally requires parent or guardian involvement and consent for account creation and personal-information processing, except where an exceptional lawful basis applies.
Parents/guardians are responsible for supervising a minor's use of the Customer Services where appropriate.
SOFF Sports may introduce age verification, parental consent, linked family accounts, or age-based feature restrictions.
3. Accounts
You must provide accurate information and keep your credentials secure.
You may not:
- impersonate another person;
- create an account using information you are not authorized to use;
- share credentials in a way that creates unauthorized access; or
- use another person's account without permission.
You are responsible for activity conducted through your account except to the extent caused by SOFF Sports' own security failure or another matter for which you are not legally responsible.
4. Memberships and Programs
SOFF Sports may offer memberships, passes, credits, subscriptions, trials, or programs such as WDDT.
The specific price, included sessions, eligible hours, sports, facilities, cancellation rules, carry-forward rules, transfer rules, booking limits, and other benefits will be described in the applicable membership offer or program rules.
Program rules form part of these Terms.
SOFF Sports may offer promotional, founding, or discounted membership rates subject to stated eligibility and continuity requirements.
5. Bookings
A booking is confirmed only when the applicable SOFF Sports booking process indicates that it is confirmed.
Availability is subject to participating-facility schedules, capacity, sport requirements, operating conditions, and other stated restrictions.
A Play Intent or Community Pulse indication is not a reservation unless the app expressly states that a booking has been completed.
6. Community Pulse and Play Intents
Community Pulse may allow users to indicate that they are Considering, Likely, or Planning to Attend a sport, facility, date, or time.
A Play Intent:
- is voluntary;
- may be changed or removed;
- does not guarantee attendance;
- does not reserve facility capacity;
- does not guarantee other members will attend; and
- may be displayed in aggregate or with limited identity information according to the user's visibility settings.
Users should not rely on Community Pulse as a guarantee that a game or session will occur.
7. Cancellations, No-Shows, Credits, and Refunds
Cancellation deadlines, credit-restoration rules, no-show rules, and refund eligibility may differ by membership, facility, session, or program.
The applicable rules will be shown in the relevant offer, booking flow, or program terms.
Where SOFF Sports or a participating facility cancels a prepaid service, SOFF Sports will provide the remedy required by the applicable program terms and law, which may include restoring a credit, rescheduling, or refunding an amount where appropriate.
8. Facility Rules and Waivers
Participating facilities are independently operated unless expressly stated otherwise.
Users must comply with:
- facility rules;
- safety instructions;
- posted policies;
- staff directions;
- capacity restrictions; and
- applicable liability-waiver or acknowledgment requirements.
Completing SOFF Sports membership terms does not automatically replace a facility-specific waiver.
9. Participant Conduct
Users must:
- respect other participants, facility staff, SOFF Sports personnel, coaches, and officials;
- respect scheduled start and finish times;
- use facilities and equipment responsibly;
- comply with reasonable safety requirements;
- avoid harassment, threats, unlawful discrimination, violence, or abusive behaviour;
- avoid fraud or misuse of bookings, credits, accounts, or promotions; and
- follow applicable Community Standards.
SOFF Sports may warn, restrict, suspend, or terminate accounts for serious or repeated misconduct.
10. Payments
Prices and taxes will be displayed before purchase.
SOFF Sports may use third-party payment processors. Payment-provider terms may also apply.
Users authorize applicable charges when completing a purchase or enabling recurring billing.
Where recurring billing is offered, cancellation instructions and renewal terms will be presented with the applicable membership offer.
11. Location, Camera, and Device Permissions
Some features may request permission to use:
- device location;
- camera;
- photo library;
- notifications; or
- other device capabilities.
Permissions are requested for relevant app functionality and can generally be managed in device settings. Declining a permission may prevent the related feature from working.
12. User Content
If users can upload profile photographs, reviews, messages, or other content, they retain ownership of content they own.
By submitting content, the user grants SOFF Sports a non-exclusive licence to host, display, reproduce, and technically process that content as reasonably necessary to provide and operate the service.
Users may not submit unlawful, infringing, abusive, deceptive, or unauthorized content.
13. SOFF Sports Intellectual Property
The SOFF Sports websites, apps, software, designs, trademarks, logos, documentation, databases, and related intellectual property are owned by or licensed to Sofficient Systems Inc.
Users receive only a limited, personal, non-transferable right to use the Customer Services in accordance with these Terms.
14. Prohibited Use
Users may not:
- access systems without authorization;
- interfere with platform security or availability;
- scrape or harvest user data without permission;
- reverse engineer software except where law expressly permits;
- use automated systems to unfairly obtain bookings;
- create fraudulent accounts;
- misuse promotions or session credits;
- sell or transfer accounts unless expressly permitted; or
- use SOFF Sports services for unlawful purposes.
15. Third-Party and Independent Facilities
Participating facilities may be independently owned and operated.
Unless SOFF Sports expressly states that it operates a particular facility or service directly, SOFF Sports acts as a technology, membership, booking, coordination, marketing, or support platform in relation to that facility.
The facility remains responsible for matters within its operational control, including premises, equipment, facility staff, and facility-specific safety requirements.
16. Health and Physical Activity
Sports and physical activity involve inherent risks, including risk of injury.
Users are responsible for considering whether an activity is appropriate for them and for following applicable safety instructions.
These Terms do not replace any waiver, informed consent, medical advice, or facility-specific risk acknowledgment that may be required.
17. Service Changes and Availability
SOFF Sports may modify services, features, facilities, schedules, or programs as the ecosystem develops.
We aim to communicate material changes appropriately.
We do not guarantee uninterrupted or error-free operation of websites, apps, third-party services, or facility availability.
18. Account Suspension and Termination
SOFF Sports may restrict or terminate access where reasonably necessary because of:
- fraud;
- serious or repeated misconduct;
- safety threats;
- abusive behaviour;
- unlawful activity;
- material breach of these Terms;
- misuse of facilities or other users' data; or
- security concerns.
Where appropriate, SOFF Sports may first provide a warning or opportunity to address the issue.
19. Account Deletion
Users may initiate account deletion using the in-app deletion process when available and the external SOFF Sports account-deletion webpage.
Account deletion is different from cancelling an active paid membership or third-party subscription. Users should follow the applicable cancellation process for recurring charges.
Some records may be retained where legally permitted or required, as described in the Customer Privacy Policy.
20. Privacy
Use of Customer Services is subject to the SOFF Sports Customer App Privacy Policy.
21. Disclaimers
To the extent permitted by law, Customer Services are provided on an “as available” basis.
SOFF Sports does not guarantee:
- that a particular facility or sport will always be available;
- that Community Pulse participants will attend;
- that a minimum number of people will form a session unless expressly guaranteed;
- uninterrupted operation; or
- specific sporting, health, social, or commercial outcomes.
Nothing in these Terms limits statutory rights that cannot legally be waived.
22. Limitation of Liability
To the maximum extent permitted by law, Sofficient Systems Inc. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Customer Services.
Nothing excludes liability that cannot lawfully be excluded, including liability subject to mandatory consumer-protection law.
Liability for injury or property loss arising from independently operated facilities may also be governed by facility-specific terms, waivers, and applicable law.
23. Governing Law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, subject to mandatory consumer-protection or other rights in the user's jurisdiction.
24. Changes to These Terms
We may update these Terms as services evolve.
Material changes may be communicated through the app, website, email, or another appropriate method. Where law requires new consent, we will seek it.
